Terms of Service

       Version from May 27, 2008

     Coverage

1.1  The following Terms of Service are applicable for all deliveries from Artwizz GmbH (subsequent; Artwizz) to the customer.

2.1  The purchase contract comes into effect with:

     Proposal and Conclusion of Contract


3.1  The presentation of products in the Online Shop do not represent a binding legal tender. Errors excepted.
 
3.2  By clicking the “Place Order” button in the last step of the order process you are committing a binding purchase
       of the products in the “Shopping Cart.” The Sales Agreement comes into effect when we confirm your order in
       an Order Confirmation email immediately following the acceptance of your payment.
 

     Right of Withdrawal

4.1  Any customer has the right to revoke his / her contractual statement without stating reasons within 2 weeks by
       either sending a receipt of the goods in writing (e.g. Letter, e-mail, fax) or by returning the goods. This period
       begins at the earliest on the day after payment has been received along with a copy of these instructions in
       written form. The prompt return of said merchandise or order satisfies a preservation of the revocation period.

     Cancellations Consequences

4.3  In the event of an effective cancellation the mutually provided goods and services shall be returned and, if applicable, any
       benefits enjoyed (e. g. interest) surrendered. In case the customer cannot return the received goods and services in total
       or in part or only in deteriorated condition, the customer has to, if applicable, provide compensation insofar. This does not
       apply for the delivery of goods, if the deterioration of the goods were due exclusively to their inspection - as would have
       been possible for you in a retail shop for example. Incidentally the customer can avoid the obligation for compensation by
       not using the goods, as if they were his/hers property, and by refraining from doing anything, that could impair their value.
       Items that are capable of being shipped are to be returned. The customer is responsible for the cost of said return, if the
       supplied commodity corresponds to the ordered and if the price of the good does not exceed 40 Euro, or if the customer
       at the time of the return has not yet been reimbursed for the return or if a contractually arranged payment installment has
       not yet been rendered. The costs of return delivery are otherwise gratis for the customer. Goods that can be dispatched
       as parcels have to be returned at our risk and expense. Goods that cannot be returned as parcels will be collected from
       your address. Obligations for refunding of payments must be fulfilled by you within 30 days after dispatch of the customer’s
       declaration of cancellation.

4.4  The Right of Withdrawal does not exist with remote paragraph contracts for the supply of software, if customer unsealed
       the supplied merchandise.

 
4.5  End of the Instructions of Cancellation
 

     Prices

5.1  The prices named on the product sites contain the legal value-added tax and other price components.

 

     Delivery

6.1  Delivery takes place by means of UPS (United Parcel Service).

6.2  The delivery times are estimated at 1-2 business days within Germany. In all other countries 2-5 business days.
       In the case of different delivery times we refer to the respective product site.
 

     Payment

7.1  Payments can be made either through Vorkasse or Paypal. Cash on delivery (COD) is possible within Germany.
 
7.2  If the costumer chooses to pay via advanced payment the company’s bank connection information will appear in the
       order confirmation.
 

     Property Reservation

8.1  Until full payment has been received, the merchandise remains our property.
 

     Warranty

9.1  The warranty is in accordance with legal regulations. In all deficiencies appearing during the legal guaranteed period of
        two years from the date of delivery, the costumers has the legal right to fulfillment and - in existence of the legal
        prerequisites - the legal rights on reduction or resignation as well as beside it on compensation.

10.1 Contract text: We store individual customers contract texts and can send the order data and our AGB per e-mail to the
        customer. The customer may also view their past orders by accessing the customer login area of the website.
